2. How to send a takedown notice
To be effective under 17 U.S.C. § 512(c)(3), your notice must include:
- A physical or electronic signature of the copyright owner or authorized agent;
- Identification of the copyrighted work claimed to have been infringed (or a representative list for multiple works);
- Identification of the material claimed to be infringing, with information sufficient to let us locate it (such as a URL);
- Your contact information (address, telephone number, and email);
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law;
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the owner.
Incomplete notices may not be actionable. Please consider whether fair use, fair dealing, or another exception applies before sending.
3. How to send a counter-notice
If material you posted was removed and you believe the removal was in error, you may submit a counter-notice under 17 U.S.C. § 512(g) including:
- Your physical or electronic signature;
- Identification of the material removed and the location it appeared before removal;
- A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification;
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, for any judicial district in which we may be found), and that you will accept service of process from the person who provided the original notice or that person’s agent.
4. Repeat-infringer policy
We will, in appropriate circumstances and at our discretion, disable or terminate the accounts of users we determine to be repeat infringers.
5. Misrepresentations
Section 512(f) of the DMCA provides that any person who knowingly materially misrepresents in a notice or counter-notice that material is infringing or was removed by mistake or misidentification may be liable for damages. Please do not make false claims.
