1. Scope
This policy applies to personal information processed by Nouvèl Ayiti Corporation as a controller in connection with the Services. It does not apply to third-party websites or services you reach through links from our Services.
2. Information we collect
Information you provide. Account information (name, email address, phone number, language preference, photo); the content of Personal Requests, Community Reports, Projects, and Connection messages; entries you add to the National Phonebook; and prompts you submit to the Liv companion.
Information about contributions. When contributions open, payments will be processed by Stripe, Inc. We will receive the contribution amount, currency, timestamp, and limited descriptive metadata (such as the last four digits of the card and the card brand). We do not receive or store full payment-card numbers.
Location information. The Ayiti app uses your approximate or precise location, with your permission, to verify that Community Reports describe the location they are sent from and to show conditions near you. You can revoke location permission in your device settings, in which case those features will be limited or unavailable.
Device and usage information. IP address, device identifiers, operating system, browser, app version, language, time zone, referring URL, pages or screens viewed, actions taken, and crash diagnostics.
Cookies and similar technologies. See our Cookie Policy.
Information from others. If you sign in using a third-party identity provider, we receive a unique identifier and basic profile information you authorize.
3. How we use information
- Operate, maintain, secure, and improve the Services;
- Authenticate users and prevent fraud, abuse, and unauthorized access;
- Aggregate Community Reports for the Safety map;
- Send transactional messages and, with your consent, occasional updates;
- Process contributions through Stripe and issue receipts (when contributions open);
- Comply with law, respond to legal process, and enforce our policies;
- Conduct research and aggregated analysis to advance our mission.
We do not use your personal information to train third-party generative-AI foundation models. The Liv companion uses third-party models under data-processing terms that prohibit their providers from training their general models on your prompts.
4. Legal bases (EEA/UK)
If you are in the European Economic Area or the United Kingdom, we process personal information under one or more of the following legal bases: performance of a contract (Article 6(1)(b) GDPR) where we operate the Services for you; legitimate interests (Article 6(1)(f)) in keeping the Services secure and improving them, balanced against your rights; consent (Article 6(1)(a)) for non-essential cookies and certain communications; and compliance with legal obligations (Article 6(1)(c)).
6. Retention
We keep personal information for as long as needed to provide the Services, comply with legal obligations (including IRS recordkeeping requirements for any future donor records), resolve disputes, and enforce our agreements. Aggregated or de-identified data that cannot reasonably be linked to you may be retained indefinitely.
7. Security
We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, encryption at rest where appropriate, access controls, and logging. No security is perfect; we cannot guarantee absolute security and you use the Services at your own risk.
8. Your rights
Depending on where you live, you may have the right to access, correct, delete, or receive a portable copy of your personal information, to restrict or object to certain processing, to withdraw consent, and to lodge a complaint with a supervisory authority. To exercise these rights, email alo@ayiti.org. We will not discriminate against you for exercising them.
9. U.S. state privacy rights
Residents of California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, and other U.S. states with comprehensive privacy laws may have additional rights, including the right to know, correct, delete, opt out of “sale” or “sharing” for cross-context behavioral advertising (which we do not engage in), opt out of significant automated decision-making (we do not engage in any), and appeal a denial of a rights request. For California residents, we do not have actual knowledge that we sell or share the personal information of consumers under 16. We honor Global Privacy Control signals where required.
10. International transfers
Nouvèl Ayiti operates from the United States. If you access the Services from outside the United States, your information will be transferred to and processed in the United States and other countries, which may have different data-protection laws than your own. Where required, we rely on appropriate safeguards, such as the European Commission’s Standard Contractual Clauses, to legitimize cross-border transfers.
11. Children
The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, please contact alo@ayiti.org and we will delete it.
12. Donors and prospective donors
Contributions are not yet open. When they open, donor information will be processed under the Donor & Refund Policy. Receipts and tax-related correspondence will be retained for the periods required by U.S. tax law.
13. Third-party links and services
The Services may contain links to third-party sites and integrate third-party tools. We are not responsible for their privacy practices. We encourage you to review their policies.
