Contributions not yet open
Nouvèl Ayiti Corporation is not currently accepting contributions. We have not opened up contributions yet while we complete the work required to receive donations responsibly. We are preparing to submit IRS Form 1023 seeking recognition as a 501(c)(3) public charity, but we have not yet filed it. We are also preparing to register to solicit contributions under the Florida Solicitation of Contributions Act (Chapter 496, Florida Statutes) with the Florida Department of Agriculture and Consumer Services. We will update this page when contributions open.
1. Why we have not opened contributions yet
We believe charitable contributions deserve a real legal foundation. Asking for money before the IRS has recognized us as exempt under Section 501(c)(3), and before we have registered to solicit in the states that require it, would put donors in an unclear position about deductibility and would put the organization out of step with state consumer-protection law. We have not opened contributions yet and will only open them once those steps are complete.
2. Our current legal status
- Entity: Nouvèl Ayiti Corporation, a Florida not-for-profit corporation organized under Chapter 617, Florida Statutes.
- Federal tax status: We are preparing to submit IRS Form 1023 seeking recognition of exemption under Internal Revenue Code Section 501(c)(3). We have not yet filed the application and are not yet recognized as a 501(c)(3) organization.
- State solicitation status: We are preparing to register under the Florida Solicitation of Contributions Act (Ch. 496, Fla. Stat.) with the Florida Department of Agriculture and Consumer Services (FDACS). Additional state charitable-solicitation registrations will be obtained where required before we solicit in those states.
3. What we tell prospective donors today
We are not soliciting. If you wish to express future interest, you may email alo@ayiti.org. We will not add you to any solicitation list, and we will not contact you for contributions until registration is complete and you have separately opted in.
4. When contributions will open
When contributions open, this page will be updated to reflect: our IRS determination letter and EIN, our FDACS registration number, the percentage of contributions used for program services, and a current copy of our IRS Form 990 (when first available). Donors will be asked to affirm that they have read this policy before completing a contribution.
5. Tax deductibility
Until we file IRS Form 1023 and the IRS issues a favorable determination letter, contributions to Nouvèl Ayiti Corporation are not deductible as charitable contributions for U.S. federal income-tax purposes. We do not provide tax advice; consult a qualified tax professional regarding the deductibility of any future contribution in your situation.
6. Payment processing
When contributions open, payments will be processed by Stripe, Inc., a third-party payment processor, under Stripe’s own terms and privacy policy. We do not receive or store full payment-card numbers. The optional “cover processing fees” line item, when offered, increases your contribution so that the net amount received by Nouvèl Ayiti after Stripe’s fees equals the amount you intended to give.
7. Recurring contributions
If you authorize a recurring contribution, your payment method will be charged on the schedule you select until you cancel. You may cancel at any time by emailing alo@ayiti.org or, where available, through your account. Cancellation stops future charges; it does not by itself refund completed charges.
8. Refund policy
Contributions are generally non-refundable because they are gifts. As a matter of donor service, we will refund a contribution in full upon written request to alo@ayiti.org within fifteen (15) days of the charge, provided the funds have not already been disbursed in furtherance of a restricted purpose you designated. Requests submitted after fifteen days will be reviewed on a case-by-case basis. Refunds are returned to the original payment method.
9. Duplicate or erroneous transactions
If you believe you were charged twice for the same intended contribution or that an error occurred, contact alo@ayiti.org within thirty (30) days of the charge. After confirming the duplicate or error in our records, we will refund the affected amount.
10. Chargebacks
If you have a concern about a contribution, please contact us first — we will work with you in good faith. A chargeback initiated through your card issuer without first contacting us may result in additional bank fees that reduce funds available for our programs.
11. Restricted vs. unrestricted gifts
Most contributions are unrestricted and may be used for any lawful purpose within our mission. If you designate a contribution to a specific program or project, we will use it for that purpose; if the designated purpose becomes impracticable, we may, consistent with Florida law and our governing documents, redirect the contribution to a related purpose that we determine reasonably approximates your intent, and we will notify you when feasible.
12. Non-cash contributions
We do not currently accept non-cash contributions (including securities, real property, or in-kind goods). When we begin accepting them, we will publish gift-acceptance procedures and follow the substantiation and appraisal requirements of IRS Publication 561 and Form 8283 where applicable.
13. Donor privacy
Donor information is handled under our Privacy Policy. We do not sell, rent, or trade donor information. We do not publish donor names without your consent. Donors may request anonymity, request not to be contacted, or request that their information be removed from our records (subject to recordkeeping required by law).
14. State solicitation disclosures
When contributions open, we will display the disclosures required by the state in which you reside. The following placeholder reflects the Florida disclosure required by Section 496.411, Fla. Stat., and will be updated with our registration number once assigned:
“A COPY OF THE OFFICIAL REGISTRATION AND FINANCIAL INFORMATION MAY BE OBTAINED FROM THE DIVISION OF CONSUMER SERVICES BY CALLING TOLL-FREE WITHIN THE STATE (1-800-435-7352) OR VISITING FDACS.gov. REGISTRATION DOES NOT IMPLY ENDORSEMENT, APPROVAL, OR RECOMMENDATION BY THE STATE. REGISTRATION #: [TO BE ASSIGNED].”
